It allows a person to act as the legal agent of another person and perform certain tasks on his behalf. The person who gives the power of attorney is called the donor or the principal and the one on whom the responsibility is shouldered is called the donee or the agent. Complete or limited authority will be given to the agent to take legal decisions about the principal’s property, finances or medical care. The legal process involves the drafting of a document which assigns the power to act as a legal representative of another person. The Principal should take all precautions in choosing an agent as attorney to avoid nuisance or any financial loss in future. He should choose a person who has the ability to keep financial records and should be trustworthy. One has to choose the agent judiciously.  An agent can take all necessary decisions related to legal issues where the principal cannot be present to sign or if he is ill or disable. A paper signed by the principal can also function as power of attorney if it gives powers to an agent but that paper should be clear and understandable. The power of attorney gets nullified if the principal dies or gets incapacitated. The power of attorney needs to be authenticated by a Sub-Registrar only or it must be notarized by the notary if the agent gets the power to sell a land. Registration of power of attorney is optional. It is not compulsory unless it creates an interest in any immovable property, i.e. if the power to sell a property is given to the agent.  If the value of the immovable property is more than Rs.100 then the power of attorney needs to be registered. A stamp duty is compulsory which has to be paid in the jurisdictional registrar’s office. 2.Credentials of an Attorney An agent or an attorney is the person who is appointed by the principal to act on his behalf. A power of attorney can be executed by any person who is proficient to enter into a contract. He must be willing to act in that capacity impartially. He has to be responsible and should act with utmost faith. He is supposed to be loyal to the donor and should never disclose any confidential matters related to the business of the principal. He should not be a miscreant and should not take advantage of his powers. He should be loyal and act in the best interest of the principal. He should understand his responsibilities and should not flow with emotions. He must use his powers judiciously. 3.Authentication of Power of Attorney A power of attorney is a legal document and needs to be framed by using the right language. The objectives and the responsibilities which the agent has to carry out on behalf of the principal should be clearly mentioned in the document. This legal document needs authentication. Hence it should be signed and notarized by a certified notary advocate. He will declare that the principal is competent at the time of signing the document or the power of attorney. The principal will also have to prove his identity with the help of an ID to the notary advocate before he certifies and issues the document. This document has to be executed and authenticated by the Registrar or Sub-Registrar of assurances as per the Registration Act, 1908.  4.Life of the Power of Attorney A general power of attorney remains active unless it is revoked or ends by the death of either of the party but a special power of attorney remains in force till the specified act does not get completed. Duration of the power of attorney depends on the type of attorney. There can also be a fixed period of power granted to the agent but it has to be mentioned in the deed by the principal. 5.Revocation of Power of Attorney Revocation is the act of recall or annulment of the powers given to the agent by the principal. A power of attorney can be revoked by the principal at any time. In doing so, the principal has to give a written notice to the agent but revocation is not applicable if the power of attorney is for a fixed period of time. Normally a power of attorney gets revoked if the principal gets bankrupt or dies or becomes insane. The principal can revoke if the matter for which the agent was appointed gets over. This can happen by mutual understanding of the two. If the agent is a spouse of the principal, then the power of attorney revokes or gets terminated in case of divorce or legal separation. The mandatory requirements are submitted in two phases. a) Preliminary Phase: All the mandatory requirements and the minimum number of credits have to be submitted in this phase. This temporary platform is erected around the building’s exterior. It is a platform on which the labours can work at different heights. Workers can move around safely in any direction to complete their work. It also helps to lift materials of construction. It is used when the height exceeds 1.5 m. 2.Scaffolding is vital Workers have to work at different heights in the construction or repair of a manmade structure.  A safe and protected workplace is very much required as they work at a variety of heights. Scaffolding gives support on heights, ensures construction at a fast pace, assures the safety and protection of the workers and general public. It creates a secure working space and gives access to those parts of the building which are normally difficult to reach. 3.Parts of Scaffolding Standards : These are Vertical / Upright posts or tubes that transfer the entire weight of the structure to the ground where they lean on a square base plate to scatter the weight     Ledgers  :  These are horizontal tubes that join between the standards, add further support and help in weight distribution.                       Braces  : These include cross or transverse braces and façade braces. Cross braces run diagonally between  ledgers increasing the structures’ overall rigidity and façade braces help the structure from swaying.                           Putlogs  :  These are horizontal braces that run perpendicular to the wall and support the standing platform of the scaffold.                     Transoms  :  These lean on the ledgers at right angles.                Bridle  :  These are horizontal braces used to bridge openings.    Boarding  : These are planks on which the workers stand during the work            Guard Rail  :  This is also known as protective rail. This is a rail that guards the men working on the boarding. It is about 1m high and protects the workers from accidentally falling off the scaffold.                Toe Board  : They are attached to the platforms. These are placed parallel to boarding near the wall and give protection to the workers. They help prevent tools such as screwdrivers from rolling off the board and also provide security to the workers.                     Base Plate : These are the plates on the ground that support the Standards. 4.Types of Scaffolding : Most prominent scaffoldings are mentioned here. 4.1. Single Scaffolding or Brick layer’s Scaffolding : This is generally used for brick masonry. It consists of standards, ledgers, putlogs which will be parallel to the wall at a distance of about 1.2m. About 2-2.5m of distance is kept between the standards. The standards are connected by ledgers at vertical intervals of 1.2 – 1.5 m. Putlogs have one end on ledgers and the other end will be right angles on the wall. These are placed at intervals of 1.2 – 1.5 m. A single row of standards is fixed into the ground. One end of putlog is fixed with wall. 4.2. Double Scaffolding : Also known as Mason’s Scaffolding is generally used for plastering or in stone masonry. It is stronger than Brick layer’s scaffolding. It has two rows of standards supported by ledgers for better support. First row of standards is fixed close to the wall and the second row of standards is fixed at a distance of 1.5 m from the first row. The first row of standards is placed 20-30 cm away from the wall. To make it strong, double rows of scaffolding are made. That’s why it is called double scaffolding. Here the putlogs are not fixed with the wall. Instead they are supported at both ends on ledgers. Double scaffolding has pairs of verticals supported on an inner system of verticals and longitudinal. For additional stability it is tied to the building at intervals when used in high rise buildings. Hence, this scaffolding is completely independent and does need any hole on the surface of the wall.  4.3. Cantilever Scaffolding / Needle Scaffolding : This type of scaffolding is fixed at some height above the ground level instead of fixing the standard in the ground. These are used where the standard cannot be fixed in the ground, when the construction is being done on the side of a busy street or when the construction is carried out at a height. The platform on which the stands are placed is called a needle, a cantilever structure, made of timber and projected out from the holes in the wall. The needle is fully braced on all sides to prevent it from lifting up or tipping over. The inside ends of the needles are supported by struts wedged between the needles and the head pieces. This will prevent the lifting up of the needle. The projected outward end of the needle is supported by an inclined strut that rests on the window sill. Cantilever Scaffolding is a separate scaffold constructed to angle out from a building. 4.4. Suspended Scaffolding : Suspended Scaffolding is used in repair work, paintings etc. This scaffolding goes with the name. Here the working platform is suspended from roofs with the help of wire ropes or chains so that it can be raised or lowered to the required height. It is usually applied in tall buildings where the height is more than 30 m.

Some sections of the Act were enforced from 1st May 2016 and all the sections of the Act came into force from 1st May 2017. As per the Act, all states must appoint a Real Estate Regulatory Authority to ensure that the purposes of the Act are carried out. It came into existence to develop and promote the sector to maintain transparency in terms of buying and selling of property. Through this act the relationship between the buyer and builder is expected to be smooth and transparent. 2. States to frame their own RERA Rules RERA is an umbrella Act which gives broad guidelines under which the Regulatory Authority of each State and Union Territory can frame their own rules and regulations. These rules are published in the respective State Gazettes. 3.The purpose of the Act is To begin the regulation and promotion of the Real Estate Sector. To make sure that transparency and efficiency is maintained in selling of Real Estate To safeguard the interest of consumers and establish adjudicating mechanisms for speedy dispute settlement in Real Estate Sector To create and maintain a website with records of registered real estate projects and agents and it should be open to public viewing. To establish an Appellate Tribunal which could hear appeals from the decisions, directions or orders of the Real Estate Regulatory Authority 4. Why did RERA come into effect Number of complaints increased from the homebuyers. Investors were scared to invest in the Real Estate Sector as there was no surety that they would not be cheated. There was no transparency in the process of a deal. Houses were being sold according to the super built up area. The buyers had no place to complain if the construction quality was not good. Project delays were becoming a common factor. 5.TSRERA Government of Telangana notified the Telangana State Real Estate (Regulation & Development)  Rules 2017 for regulation and promotion of Real Estate Sector in the state of Telangana. The Telangana Government notified the Telangana Rules under RERA on 31st July 2017. These rules came into force from the date of publication in the Telangana Gazette on 4th August 2017. They are called Telangana State Real Estate Regulatory Act.(TSRERA) 6.Main objectives of TSRERA To manage various aspects of Real estate sector To regulate the sector To standardize the constructions To advocate transparency between builders and homebuyers To arrange for speedy redressal of disputes. 7. Rules of TSRERA Residential as well as commercial projects have to be registered with RERA if the area of the proposed property is more than five hundred square meters. If the project has to develop in phases then each phase has to be registered separately. Registration is required if the project has more than eight apartments. If a project is not registered with RERA, then the penalty could be 10% of the project cost and if the offense is repeated, then the penalty could go up to 3 years of imprisonment. Any change in the declared plan of the project needs the consent of the buyer. If there are more number of buyers then 2/3 of the total number should support the change. Timelines have to be respected. Any delay in the timeline will be called for penalty. 70% of the project amount has to be deposited in a neutral account and has to be used only for construction. In this way siphoning will be restricted. The buyer should take the possession of the house within two months from the date of completion. The developers should upload the details of the project on the website and have to update quarterly. 8. Who is Exempted from registering with TSRERA If the proposed area of the property does not exceed500 sq m If the number of apartments proposed to be developed does not exceed eight. If the Project Completion Certificate for a project was received before the commencement of RERA Act. Those which are undergoing renovation and do not require marketing, advertising, or selling under the Real Estate Project are exempted from registering with TSRERA. 9.SERVICES PROVIDED BY TSRERA Benefits for Home Buyers A home buyer has the right to know about the property. The developer should share all the details about the project such as layout and execution of the plan, status of construction and stages of completion. Carpet area as per RERA is that area which does not include the lobby area or the thickness of the walls. Builders have to offer the price based on the carpet area and not on the super built up area. If any fault is noticed in the construction of an apartment within 5 years of taking possession, then the builder is responsible for its repair. Once the structural defect is detected, it should be repaired within 30 days. Grievances will be addressed and solved quickly. If the builders fail to complete the project in the timeline mentioned, then they will have to face penalties. Benefits for Promoters A promoter can register his real estate project under RERA. They will be given a registration number for each of their registered projects. They have to update the details of their projects quarterly. They can file a request for an extension of the delivery date of their projects. They also have the right to file a complaint if any.
