Property registration is stamping and paying the registration charges for a sale deed and getting it legally recorded at the sub-registrar’s office. If a property is purchased, then it has to be registered in accordance with Registration Act 1908. The transactions that involve the sale of an immovable property for a value exceeding Rs 100 has to be registered. Registration is required when there is a transaction of sale, lease, transfer or gift of a property. The buyer has to pay the registration fee to the government as a small percentage of the total cost of the property. Stamp duty is charged during the submission of the documents. It is also a small percentage of the cost of the property and declares that the documents submitted are original. Registration is an important document to ascertain the title of the property. This gives a title and a legal ownership.
In Telangana, the property has to be registered with the Telangana Registration and Stamp Department. The government has made the registration a bit easy because a part of the process can be done online, where the documents have to be uploaded online. The buyer, along with the seller and witnesses has to visit the sub-registrar’s office, nearest to the location of the property to pay the stamp duty and the registration charges as applicable in the state.

4.Step by Step process of Registration
Here is the step by step process to register the property online in Telangana.
A . Pre- Registration Procedure
- Step 1 : Visit the Telangana Property Registration Portal – https://registration.telangana.gov.in/ and create a login ID.
- Step 2 : Upload all the required documents, pay the registration fees and stamp duty on the portal.
- Step 3 : Book the time slot to visit the Sub-Registrar’s Office to complete the proceedings of Registration.
B. Proceedings at Sub –Registrar’s Office (SRO)
- On the appointed date and time, you have to be at the Sub-Registrar’s Office along with the documents to be registered.
- A check-slip will be prepared by the respective officer based on the details which you had uploaded on the portal. He will also make changes if required.
- Then the officer will complete E-KYC and collect fingerprints of the registering parties which will be verified against the database.
- Then a verification challan is provided after the complete verification of the paid fee charges.
- Finally the Registrar will print the endorsements on the document being registered.
- He will also provide a document number and collect the thumb impression of the parties.
- At last, the registered document will be scanned and uploaded on the portal. The user can download the same from the portal.
- In case of verification being unsuccessful, the buyer will be directed to make the required changes and resubmit the application.
5.Create a Sale Deed
This is created by the property owner. Sale deed is an agreement to sell a property to a buyer. It has to be drafted by a legal draftsman on a non-judicial stamp paper of the requisite value. The party has to use five non-judicial stamp papers and the remaining amount has to be paid as mentioned by the state government. The sale deed should include the following clauses :
- Name of the deed : The parties should decide by mutual consent about the type of deed that has to be prepared for transfer of the property. The type of deed should be clearly mentioned on the document.
- Names of parties involved : The names, ages and addresses of the parties involved in the transaction should be there on the sale deed along with their signatures.
- Description of the property : The property on the deed has to be described completely . The description should include all details like- identification, plot number, location etc.
- Sale Consideration Clause : The price decided by the mutual consent of both the parties should be mentioned .
- Token & Mode of Payment : A sale deed should have a clear information about the token amount paid as well as the mode of payment of sale amount.
- Possession date : The sale deed should also mention the date when the property is going to be transferred as well as the date of possession.
- Indemnity Clauses : As per this clause, the seller is liable to bear all the statutory charges including property tax, electric charges , water bill and other charges in relation to the property, before the execution of the sale deed.
6.Precautions – Before Registering a Property
- Chain of Documents : These documents signify when and how the property has been transferred from one owner to the other till date. All the chain of documents should be checked before buying a property.
- Encumbrance : An encumbrance is a claim against a property by a party that is not the owner. This creates difficulty in transfer of property registration. Encumbrance includes outstanding mortgages, liens of real estate, property tax liens, etc. The buyer should get all the encumbrances cleared if any. Encumbrances can be checked at the SRO.
- No Dues : The buyer should check that the property is free from any dues like – property taxes, electricity bills, water bills etc.

So before going to the concerned Registrar Office, one has to upload the required details on the Public Data Entry System, pay the stamp duty and registration fees and book a slot to complete the property registration procedure at the Registrar Office by physical presence at the appointed date and time. Public data entry facility helps the applicant to provide the required information on the portal before visiting the SRO. This will reduce the time and also accurate information will be supplied. Registration and stamp duty vary according to the State of Registration. Stamp duty is calculated depending on the market value of the property which in turn depends on the location of the property.
